Acceptable Use Policy

Effective Date: January 1, 2024

This Acceptable Use Policy ("AUP") governs the use of all services provided by BlueStream Consulting, LLC ("BlueStream"), including managed IT services, cloud computing, VoIP, SIP trunking, unified communications, and related services. By using BlueStream's services, Client agrees to comply with this AUP. Violation of this AUP may result in suspension or termination of services.

1. Purpose

1.1 Objective. This AUP is designed to protect the integrity, security, and reliability of BlueStream's network and services, protect other customers and third parties from harm, and ensure compliance with applicable laws and regulations.

1.2 Applicability. This AUP applies to Client, Client's employees, contractors, agents, and any end users who access BlueStream's services through Client's account.

2. Prohibited Activities

2.1 Illegal Activity. Client may not use BlueStream's services to engage in any activity that violates applicable federal, state, or local laws or regulations, including but not limited to the Computer Fraud and Abuse Act, the Electronic Communications Privacy Act, the CAN-SPAM Act, and the Telephone Consumer Protection Act (TCPA).

2.2 Unauthorized Access. Client may not use BlueStream's services to gain unauthorized access to any computer system, network, or data, including through hacking, password mining, or exploitation of security vulnerabilities.

2.3 Malware and Harmful Code. Client may not transmit, distribute, or store viruses, worms, Trojan horses, ransomware, spyware, or any other malicious code through BlueStream's services or infrastructure.

2.4 Spam and Unsolicited Communications. Client may not use BlueStream's services to send unsolicited bulk email (spam), unsolicited commercial text messages, or unsolicited robocalls. All commercial electronic communications must comply with applicable anti-spam and telemarketing laws.

2.5 Network Abuse. Client may not engage in activities that degrade the performance or availability of BlueStream's network or services for other customers, including denial-of-service attacks, port scanning, packet flooding, or excessive bandwidth consumption inconsistent with normal business use.

2.6 Intellectual Property Infringement. Client may not use BlueStream's services to reproduce, distribute, or transmit copyrighted material without authorization, or to engage in any activity that infringes the intellectual property rights of any third party.

2.7 Harassment and Harmful Content. Client may not use BlueStream's services to harass, threaten, defame, or harm any individual or organization, or to transmit content that is obscene, abusive, or otherwise objectionable under applicable law.

2.8 Fraudulent Activity. Client may not use BlueStream's services to conduct fraud, phishing, identity theft, or any other deceptive practice, including impersonating BlueStream or any other entity.

2.9 Toll Fraud. Client may not use BlueStream's voice or SIP services to engage in toll fraud, including unauthorized use of calling cards, PBX hacking, or any scheme to obtain telecommunications services without payment.

3. Security Responsibilities

3.1 Account Security. Client is responsible for maintaining the confidentiality of all account credentials, including usernames, passwords, and API keys. Client must promptly notify BlueStream of any suspected unauthorized access to Client's account.

3.2 Endpoint Security. Client is responsible for maintaining appropriate security controls on all devices and systems connected to BlueStream's services, including firewalls, antivirus software, and timely application of security patches.

3.3 Incident Reporting. Client must report any security incident, data breach, or suspected compromise of BlueStream's services to BlueStream within twenty-four (24) hours of discovery.

4. Content Standards

4.1 Lawful Content Only. All content transmitted, stored, or processed through BlueStream's services must comply with applicable law. BlueStream does not monitor Client content but reserves the right to remove or block content that violates this AUP upon becoming aware of such content.

4.2 No Child Exploitation Material. Transmission, storage, or distribution of child sexual abuse material (CSAM) or any content that sexually exploits minors is strictly prohibited and will be reported to law enforcement.

5. Enforcement

5.1 Investigation. BlueStream reserves the right to investigate suspected violations of this AUP. Client agrees to cooperate with any such investigation and to provide BlueStream with reasonable access to relevant information.

5.2 Remedies. Upon determining that a violation has occurred, BlueStream may, at its sole discretion: (a) issue a warning; (b) suspend the affected service; (c) terminate the affected service or the entire Agreement; or (d) report the violation to law enforcement authorities.

5.3 No Liability for Enforcement Actions. BlueStream will not be liable to Client for any damages resulting from enforcement actions taken in good faith pursuant to this AUP.

6. Reporting Violations

6.1 How to Report. To report a suspected AUP violation, contact BlueStream at [email protected] or 352-432-4200. BlueStream will investigate all reports and take appropriate action.

7. Amendments

7.1 Updates. BlueStream may update this AUP at any time. Continued use of BlueStream's services following notice of an updated AUP constitutes Client's acceptance of the revised terms.
